First things first, we are speaking of Intellectual Property law, or in layman’s terms IP Law. Since your idea is not a tangible object but is considered your property, you must take certain steps to protect your property. The first bit of advice we can provide is if you have not already, don’t talk to anybody you do not trust about your idea. We also would suggest when you do find your attorney that you have them sign a non-disclosure agreement or NDA. Any reputable firm will be willing to sign a NDA with you in order to assist you with your idea.
What we would want to do is assist you file a patent to protect your IP. A patent is a set of special rights given by a government to an inventor for a limited amount of time. This is exchange for the public disclosure of said invention. The owner of the patent, just like any other physical property, the owner can sell, mortgage, assign, transfer, give away, or abandon the patent. Additionally, a patent can be licensed.
However, one key difference is that if your patent improves a prior patent, for example, somebody’s invention, you need to obtain the permission of the current patent holder in order to use the improved invention.
